ASHA-IIE-JURISDICTION — ASHA Issues in Ethics: Board of Ethics Jurisdiction (2025)
What does ASHA-IIE-JURISDICTION say?
Understanding when and how the ASHA Board of Ethics has jurisdiction is important for practitioners. Key guidance: (1) The BOE has jurisdiction over current ASHA members and certificate holders, and over those who were members/certificate holders at the time of the alleged violation. (2) The BOE does NOT have jurisdiction over students, unless they are also ASHA members. (3) The BOE does NOT have jurisdiction over non-ASHA members, even if they are licensed SLPs or audiologists. (4) Jurisdiction is separate from and independent of state licensure board authority — the BOE and state boards may investigate the same matter independently. (5) If a member/certificate holder's credentials lapse, the BOE may still address violations that occurred while they held certification. (6) Certified assistants are subject to the Assistants Code of Conduct, which is enforced by the BOE. (7) The BOE can impose sanctions including reprimand, censure, suspension, revocation of membership/certification, and cease and desist orders. (8) Findings are reported to relevant licensing authorities. (9) The complaint process is confidential during investigation. (10) Reports may be filed by anyone — membership is not required to file a complaint. Relevant Code sections: All four Principles; Code of Ethics Preamble (applicability and scope).
